My commercial landlord is being foreclosed on, does anything change?
My business is doing poorly and I want to close. My landlord is due in court at the end of the month for foreclosure of the building I rent in. Can I get a better lease termination deal (currently 50% of remaining lease) after the bank takes over or what?!?
Typically the lease is taken over by the acquiring party. Still, if he is about to be foreclosed on I’d go to him (like now) and offer him some money for you just to leave now. If he’s going to lose the property in 1 month and you offer him 2 months rent to leave he’d be a fool not to take it.
